We are a company based in Florida, USA. Our services are directed at German-speaking people in the United States. The processing of personal information is governed by the laws of the United States and the State of Florida.

2. Our role — and who is responsible for your treatment records

Peak Growth Center LLC is a referral platform and is not itself a therapy or health care provider. Care is delivered by independent, licensed providers; the treatment relationship is directly between you and the individual provider.

Your provider keeps your medical record

Your clinical records — history, diagnoses, session notes — are kept and controlled by your treating provider, not by us. Your provider also gives you their own Notice of Privacy Practices and is your first point of contact for anything concerning your record.

We handle billing on their behalf

Where we prepare invoices and superbills on behalf of your provider, we process protected health information (PHI) as a business associate under HIPAA and are bound by a business associate agreement with them.

Everything else is ours to answer for

For information you give us directly — waitlist signup, emails, use of this website — we are responsible. That information is not treatment data.

Not an emergency service. The platform is not intended for medical or psychiatric emergencies. If you are in an acute crisis or having thoughts of harming yourself or others, call 988 (Suicide & Crisis Lifeline) or 911 immediately.

3. What information we process

We process personal information only as far as our services require:

Waitlist and contact details

Name, email address, and phone number where applicable, when you join the waitlist or write to us.

Communication content

What you tell us by email or message — so that we can handle your request.

Billing information (PHI)

For preparing invoices and superbills on your provider's behalf: name, session date, service and diagnosis codes (CPT/ICD). We limit this to what billing actually requires.

Technical usage data

IP address, browser type, operating system, referrer URL, and time of access when you visit this website — for secure operation and troubleshooting.

4. What we use it for

To notify you when our referral service launches, if you are on the waitlist

To connect you with a suitable independent, licensed provider

To issue invoices and superbills on your provider's behalf

To answer your questions

To operate this website securely and reliably

To meet our legal obligations

We do not sell personal information and do not share it for third-party advertising. We do not use your data for profiling or automated decision-making.

5. When we share information

As a rule we do not share your information with third parties. Exceptions apply only in these cases:

With the provider we connect you to — with your agreement

With service providers working for us (e.g. hosting, secure telehealth and billing systems) who are contractually bound to confidentiality; for PHI, under a business associate agreement

Where the law requires it — such as mandatory reporting under Florida law, court orders, or to prevent a serious threat to health or safety

With your explicit prior consent

6. How long we keep it

We keep waitlist and contact details until you unsubscribe or ask us to delete them. Billing records are retained for as long as tax and regulatory requirements demand. Retention of your clinical records is your provider's responsibility and follows the requirements of the State of Florida and their licensing board (as a rule at least 7 years after the last contact, and longer for minors). After that, data is securely deleted.

7. Cookies and tracking

This website uses only technically necessary cookies. We use no third-party advertising, tracking, or analytics services — no Google Analytics, no social media pixels, no retargeting. Your behavior is not tracked across sites.

8. Security and breach notification

We protect your information with technical and organizational measures that reflect the state of the art: TLS/SSL encryption of transmission channels, access controls on a minimum-necessary basis, and regular review of our systems.

If a security incident affecting your information does occur, we will notify you and the responsible authorities within the legally required timeframes — under the HIPAA Breach Notification Rule, the Florida Information Protection Act (F.S. 501.171), and, where applicable, the FTC Health Breach Notification Rule.

9. Your rights

Access to your medical record

Your right to inspect and obtain a copy of your clinical records arises under HIPAA and Florida law. Direct that request to your provider — they keep the record.

Correction

You may ask to have inaccurate information corrected or amended. For clinical records, contact your provider; for everything else, contact us.

Deletion of your contact details

You may ask us at any time to delete your waitlist and contact details. Records we are legally required to retain are unaffected.

Unsubscribing

You can unsubscribe from our emails at any time, at no disadvantage to you.

Withdrawing consent

You may withdraw any consent you have given at any time, with effect for the future.

Complaints

You may complain to us without fear of retaliation. For complaints about the handling of health information, you may also contact the U.S. Department of Health and Human Services, Office for Civil Rights.

10. Minors

Our services are intended for people aged 18 and over. We do not knowingly collect information from children under 13. If such information reaches us by accident, we delete it.

11. Visitors from the EU and EEA

Our services are directed at German-speaking people in the United States. Telehealth sessions are only possible if you are physically located in Florida at the time of the session — we therefore do not offer our services to people located in the European Union, and we do not monitor the behavior of people in the EU. The site is available in German because our audience speaks German, not because it targets the EU market.

If you write to us from the EU, we process what you send us solely in order to reply. Your information is processed in the United States, where the level of data protection differs from the EU. On request we will tell you what information we hold about you and delete it, unless retention obligations prevent us from doing so.

12. Changes to this policy

We update this policy when our services or the legal requirements change. The current version is always available here. We will inform active clients of any material changes.
